Terms of Service

Your agreement with us

These Terms apply when you create an account, subscribe to, or use Kryptonote. By doing so, you agree to them. If you do not agree, do not use the service.

Kryptonote Labs is the informal name under which Kryptonote is operated. It is not an incorporated company. In these Terms, “Kryptonote”, “we”, “us”, and “our” mean the operator of the Kryptonote service.

Who may use Kryptonote

You must be at least 18 years old, or have permission from a parent, guardian, or another person who is legally able to agree to these Terms for you.

Accounts are for individual use. Keep your sign-in details secure, do not share or transfer your account, and tell us promptly if you think someone else has accessed it. You are responsible for activity carried out through your account.

The service

Kryptonote provides workspaces, file tools, AI features, agents, and related services. We may add, change, suspend, or remove features or integrations without notice. We do not guarantee that any particular feature, model, or provider will always be available.

Models can change at any time. Where reasonably possible, we will identify models that are being deprecated so you can prepare for the change.

Experimental features

Features marked beta, preview, experimental, or similar may be unfinished, unreliable, or removed. They can create additional risks, including errors, interrupted work, and loss or corruption of data. Do not rely on them for your only copy of important work.

Plans, billing, and cancellation

Paid plans are billed monthly in advance and renew automatically until cancelled. Prices, included features, and usage limits may change. We aim to expand rather than reduce usage limits, but we cannot promise that limits will only increase.

We will give reasonable advance notice of a price increase where required by law. A new price applies from a later renewal, so you can cancel before it takes effect.

Monthly usage credits

Each paid plan includes a monthly allocation of usage credits which is made available to your account when the billing period begins. Credits are for your individual use within Kryptonote. They are non-transferable, have no cash value, and expire at the end of the billing period. They measure the paid AI and agent processing supplied to you.

Immediate access and your withdrawal right When you subscribe, you expressly ask us to provide paid access immediately, before the end of any statutory withdrawal period. You consent to the immediate supply of digital content and acknowledge that, where the law permits, your withdrawal right is lost once that supply begins. You also expressly request immediate performance of any part of Kryptonote treated as a service.

If a statutory withdrawal right remains after paid access begins, you must pay for the proportion of the service already supplied. Unless applicable law requires another method, we calculate that proportion using the percentage of your monthly usage credits consumed before withdrawal. If you have consumed the full monthly allocation, the full subscription price may be payable and no refund may remain due. The amount retained will never exceed the price paid for that billing period.

Cancellation stops future renewals. You will retain paid features until the end of your current monthly billing period, after which your account is moved to the available free plan. You will not receive a refund or credit for unused time, features, or usage if you cancel your subscription or delete your account, except where required by applicable law.

If a payment fails, we may retry it, restrict paid features, or downgrade the account. We handle exceptional billing issues case by case.

Your content

You keep ownership of the prompts, files, and other material you upload, as well as generations produced for you, to the extent the law allows ownership of them. AI output may not be unique, and other users may receive similar output.

You give us a limited, non-exclusive licence to host, copy, process, transmit, and display your content only as needed to provide, secure, and support Kryptonote and to carry out your requests. This licence allows us to use service providers for those purposes and ends when the content is no longer reasonably needed, subject to backups and legal retention.

You must have the rights and permissions needed to submit content and ask us to process it. You are responsible for your content and for deciding whether an output is suitable to use. We do not train AI models on your data.

Kryptonote’s content and technology

Except for your content, Kryptonote and its software, design, branding, documentation, interfaces, and underlying technology belong to us or our licensors. These Terms let you use the service; they do not transfer those rights to you.

You may give us feedback. If you do, we may use it without restriction or payment, but we do not acquire ownership of the underlying content in your workspace.

Acceptable use

You must not use Kryptonote to:

  • Upload or create illegal content, malware, harmful files, or material that infringes copyright, privacy, or other rights
  • Exploit, abuse, threaten, harass, impersonate, or harm another person, including our staff and other users
  • Facilitate fraud, unlawful violence, sexual exploitation, or other serious wrongdoing
  • Bypass usage limits, safety controls, account restrictions, suspensions, or bans
  • Probe, disrupt, overload, scrape, reverse engineer, or gain unauthorised access to the service or another account
  • Share, resell, transfer, or automate access to an individual account without our written permission
  • Misrepresent AI output as human-created where doing so would deceive or break the law

We may investigate suspected misuse and preserve or disclose information where reasonably necessary to protect people, enforce these Terms, or comply with law.

AI output requires your judgement

AI and agent features can be incomplete, inaccurate, misleading, offensive, or unsafe. They can misunderstand a source, invent facts, produce insecure code, or give advice that is not appropriate for you.

You must review and verify every generation before relying on, publishing, or acting on it. Do not use Kryptonote as a substitute for qualified legal, medical, financial, safety, or other professional advice. You are responsible for decisions and actions taken from an output.

To the fullest extent permitted by law, we are not responsible for loss, damage, injury, or other consequences caused by your reliance on or use of AI-generated content.

Availability and data

Kryptonote is provided on an “as available” basis. We do not guarantee uninterrupted access, uptime, error-free operation, permanent storage, or that the service will meet every requirement. Keep independent copies of work you cannot afford to lose.

Nothing in these Terms limits promises or rights that cannot legally be excluded, including applicable statutory consumer rights.

Suspension and termination

You may stop using Kryptonote at any time. We may restrict, suspend, or terminate an account if we believe it is necessary to protect the service or another person, respond to legal risk, address non-payment, or enforce these Terms. For serious misuse, we may act without notice.

We may also end an account or the service at our discretion. Unless the law requires otherwise, a suspension or termination caused by your breach does not entitle you to a refund. Other situations, including any refund or period to export content, are considered case by case.

Terms that by their nature should continue, including ownership, liability, disputes, and amounts owed, survive termination.

Our responsibility to you

To the fullest extent permitted by law, Kryptonote is not liable for indirect, consequential, special, exemplary, or punitive loss, or for lost profits, revenue, business, opportunity, goodwill, or data.

To the fullest extent permitted by law, our total liability arising from or connected with Kryptonote or these Terms is limited to the amount you paid us during the six months before the event giving rise to the claim.

We do not exclude or limit liability where doing so is unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and mandatory consumer rights. If you use Kryptonote as a consumer, these Terms do not exclude liability for reasonably foreseeable loss caused by our breach where the law does not permit that exclusion.

Claims caused by misuse

To the extent permitted by law, you will reimburse us for reasonable losses, liabilities, and costs arising from a third-party claim caused by your unlawful content, your material breach of these Terms, or your deliberate misuse of Kryptonote. This does not apply to the extent a claim was caused by us, and it does not reduce rights you have as a consumer.

Resolving a problem

We would rather solve a problem informally. Before starting formal proceedings, email legal@kryptonote.com with a description of the issue and the outcome you want. We will both try in good faith to resolve it for 30 days.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, you keep any mandatory protections given by the law where you live and may use your local courts where that law allows.

Changes to these Terms

We may update these Terms as Kryptonote and the law change. We will post the new version here and update the date above. For a material change, we will provide reasonable notice where required. Continuing to use Kryptonote after the change takes effect means you accept the updated Terms; if you do not, you should cancel and stop using the service.

General terms

These Terms and the policies they refer to are the entire agreement about your use of Kryptonote. If one part cannot be enforced, the rest remains in effect. A delay in enforcing a term is not a waiver. You may not transfer this agreement without our permission; we may transfer it as part of a reorganisation or transfer of the service, subject to applicable law.
